Live Showing/Taped 5/12/2021 | This class will focus on the application of the loss provision under the terms of the 2006 ALTA Owner and Loan policies of title insurance. Tendering a claim and establishing coverage under the terms of the title policy is only the first step toward resolution of a title claim. Once the title company has accepted coverage for the defect, the insured still needs to work with the title company to determine the methods of resolution that are available. This is our central question for the class: How do we figure out how much to pay the Insured in the event of a title defect that is covered by the terms of the title policy? The measure of loss, like anything relating to contracts and real estate, will be performed on a case by case basis. We will not get to all of the considerations relating to determining loss under a title policy. Each type of title defect will require us to make different practical considerations, and each parcel of Land will have its own characteristics that will influence the calculation of the loss payment. Deeds to downtown lots were often used as poker chips in card games. Deeds were issued by companies that had no actual title to give, yet people paid money for them anyway. When the federal government finally issued a town site patent to nearly 1000 acres in the heart of downtown Denver, the local probate judges then handed out individual deeds. Many of those transfers were called into question, especially those issued by one particularly notorious probate judge who was also a war hero and potentially a war criminal. No, titles today just aren’t what they used to be. Fortunately!
